General terms and conditions for holiday apartment Mariposa bookings at www.vakantieincuracao.nl or directly with the owners (landlord) of www.vakantieincuracao.nl and of holiday apartment Mariposa.
Article 1 - Applicability
These general terms and conditions apply to all reservations and agreements regarding the rental of the holiday apartment Mariposa via www.vakantieincuracao.nl or directly with the owners (landlord). By making a reservation, the tenant agrees to these general terms and conditions.
Article 2 - Reservation and Confirmation
1. Reservations can be made via the website www.vakantieincuracao.nl or directly with the owners (landlord).
2. A reservation is final upon receipt of a payment confirmation by e-mail from the landlord.
3. The tenant is obliged to check the accuracy of the reservation details and to report any errors immediately.
Article 3 - Payments
1. When making a reservation, a deposit of 100% of the total rental amount must be paid. Unless otherwise agreed with the landlord.
2. In the event of late payment, the landlord reserves the right to cancel the reservation. Refund of the deposit will take place in accordance with the cancellation conditions (article 4).
Article 4 - Cancellation
1. Cancellations must be communicated in writing or by e-mail.
2. In the event of cancellation up to 60 days before the arrival date, 100% of the deposit will be refunded.
3. In the event of cancellations within 60 days before the arrival date, no refund will be made.
4. Reservations made during promotional periods, such as Black Friday sales weeks, are always non-refundable. This means that no refunds will be issued regardless of the time of cancellation.
5. The landlord advises the tenant to take out travel and cancellation insurance.
Article 5 - Arrival and Departure
1. The holiday apartment is available from 4 p.m. on the day of arrival.
2. On the day of departure, the tenant must leave the apartment before 11 a.m.
3. Early arrival or late check-out is only possible after prior approval by the landlord. The costs for an early check-in or a late check-out are €50,-.
Article 6 - Use of the Holiday Apartment
1. The holiday apartment may only be used by the number of persons specified during the reservation.
2. Tenants are expected to treat the apartment and its inventory with care. Any damage caused by the tenant must be compensated.
3. It is not permitted to organize parties or events in the apartment without the prior permission of the landlord.
4. The apartment is non-smoking and pets are not allowed, unless otherwise agreed.
Article 7 - Water and electricity consumption during the rental period
1. Water consumption is included in the nightly price.
2. Electricity is charged according to consumption. The landlord's host will record the meter readings with the tenant when checking in and out. The costs will be settled with the deposit (see article 8). The costs for this amount to € 0.50 per kWh.
Article 8 - Deposit
1. The landlord requests a deposit of 300 EUR or 300 USD or 600 ANG, which must be paid no later than 7 days before arrival.
2. The deposit will be refunded within 7 days after departure, and after deduction of the electricity costs, provided that the apartment has been left in good condition.
Article 9 - Liability
1. The landlord is not liable for loss, theft or damage to the tenant's property.
2. Damage to the apartment: Guests are responsible for damage or loss caused by their negligence, careless use or violation of the house rules. Any repair or replacement costs will be charged to the guest. Report any damage or problems immediately upon check-in.
3. The landlord is not liable for accidents, injuries or illnesses that occur during the tenant's stay in and around the apartment and resort. Not even if these are caused by the use of the goods/furniture and facilities (such as the swimming pool) made available at the resort. The use of the apartment, the facilities and the swimming pool is entirely at your own risk.
4. The tenant is responsible for complying with the house rules and for damage caused by himself or by his fellow travelers.
Article 10 - Force Majeure
In the event of force majeure, such as natural disasters, pandemics or other unforeseen circumstances, which prevent the stay from taking place, the landlord will consult with the tenant about an alternative stay period or refund.
Article 11 - House rules
The house rules apply at all times.
Article 12 - Applicable Law
These general terms and conditions are governed by Dutch law. Disputes arising from the rental of the holiday apartment will be submitted exclusively to the competent court in the Netherlands.
